Terms and Conditions
1. Scope and contracting party
These Terms and Conditions apply to every order placed through [⚠ CÉGADAT — kitöltendő cégalapításkor: végleges domain] (the "Shop"). The contracting party for every order is:
[⚠ CÉGADAT — kitöltendő cégalapításkor: cégnév] [⚠ CÉGADAT — kitöltendő cégalapításkor: székhely címe] Email: [⚠ CÉGADAT — kitöltendő cégalapításkor: ügyfélszolgálati e-mail cím]
These Terms apply to consumers within the meaning of applicable EU consumer-protection law. Where a mandatory provision of the consumer's home-country law is more protective than a provision below, the more protective local provision prevails.
2. Placing an order
- Products are presented in the Shop together with their price and main characteristics; this presentation does not itself constitute a binding offer, but an invitation for the customer to submit one.
- Adding a product to the cart does not create any obligation. The customer reviews the cart contents and enters delivery and contact details during checkout.
- Before the order is submitted, the checkout review step summarises the products, quantities, prices, delivery address and chosen shipping method.
- The order becomes a binding offer to purchase when the customer clicks the button explicitly labelled "Place order — obligation to pay" (or the equivalent payment button where card payment is used). This label makes clear, before the order is submitted, that placing the order carries a payment obligation.
- [⚠ CÉGADAT — kitöltendő cégalapításkor: cégnév] accepts the offer, and the contract of sale is concluded, [⚠ DECISION NEEDED: confirm the acceptance model — e.g. "when the order-confirmation email is sent" vs. "when the goods are dispatched"] at that point. The order-confirmation email is sent to the email address provided at checkout and records the content of the concluded contract.
3. Prices and payment
- All prices shown in the Shop are gross prices, inclusive of the value-added tax applicable in the customer's country of delivery (the destination-country VAT rate).
- Payment is made by card, processed by Stripe. No other payment method is currently offered.
- Payment is charged at the time the order is placed.
- The invoice for each order is issued electronically (e-invoice) and sent to the email address provided at checkout, in accordance with Section 175 of the Hungarian VAT Act (Áfa tv.). By placing an order, the customer consents to receiving the invoice in this electronic form.
4. Delivery
- Goods are shipped to delivery addresses in Hungary, Germany, Austria and Ireland.
- The estimated delivery time is 2–5 business days from order confirmation, subject to product and destination. This is an estimate, not a guaranteed delivery date, unless stated otherwise for a specific product.
- Risk of accidental loss or damage to the goods passes to the customer upon delivery to the customer (or a person designated by the customer), in line with mandatory EU consumer-protection rules.
5. Retention of title
Delivered goods remain the property of [⚠ CÉGADAT — kitöltendő cégalapításkor: cégnév] until paid for in full. As payment is collected at the time of ordering, this clause is of limited practical relevance under the Shop's current payment model.
6. Right of withdrawal
Consumers have a statutory right to withdraw from the contract. See the Withdrawal Policy for the full instructions, the withdrawal deadline, and the model withdrawal form.
7. Statutory warranty (conformity of goods)
Goods sold through the Shop are covered by the statutory warranty for lack of conformity under applicable EU consumer-sales law (in particular, the two-year minimum warranty period from delivery). This statutory warranty is separate from, and unaffected by, any additional manufacturer's guarantee that may be offered for a specific product; where no separate manufacturer's guarantee is advertised, only the statutory warranty applies.
8. Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law. Beyond that, [⚠ CÉGADAT — kitöltendő cégalapításkor: cégnév]'s liability is limited to foreseeable, contract-typical damage, except where caused intentionally or by gross negligence.
9. Online dispute resolution
See the Imprint page for the ODR platform link and our statement on participation in consumer arbitration proceedings.
10. Applicable law and jurisdiction
These Terms are governed by the law of [⚠ DECISION NEEDED: the company's home jurisdiction, once formed], without prejudice to any mandatory consumer-protection provisions of the customer's own country of habitual residence, which continue to apply and take precedence where more favourable to the consumer.
